TikTok Shop sellers or IP rights owners in Vietnam need to report Sở hữu trí tuệ (IP) infringements or have received an IPR infringement notice in error. The policy applies to IPR owners, authorized representatives, sellers, and creators on TikTok Shop platform.

IPR owners or their representatives may file an IPR infringement notice on TikTok Shop. Intentionally submitting misleading or fraudulent notices may lead to liability for damages or other penalties under local laws. Rightsholders are encouraged to first contact the entity and/or individual user who listed the product/posted the content or account owners to try to resolve issues directly. IPR infringement notices may be submitted via two platforms: (1) TikTok Shop’s Sở hữu trí tuệ Protection Centre (IPPC) — for IPR owners/authorized representatives to submit infringement notices; (2) TikTok Shop’s Intellectual Property Rights Report form — for those unable to access IPPC to file an online IPR infringement notice. If a seller or Creator receives an IPR infringement notice in error or believes they are authorized to use the product/content, they can: (1) reach out to the IPR owner directly to request a retraction; (2) file an Kháng cáo via Seller Center (for Sellers) or TikTok app (for Creators), following Seller Appeal Guidelines or Creator Appeal Guidelines. Appeal must include: Identity Information (full name for individuals; business registration certificate for entities); Contact information (address, e-mail, telephone number, statement consenting to jurisdiction where Platform is located and accepting service of process from claimant if applicable); Nature of the Counter-notification (identify removed/disabled product/content and detailed explanation why not infringing or removed by mistake/misidentification); Proof of IPR or authorisation (registration certificate from relevant authorities, or supporting documents signed/stamped by IPR owner if not the owner); Good-faith Statement (under penalty of perjury, good faith belief material was removed due to mistake or misidentification); and any other supporting materials. The following IPR infringement notices may NOT be accepted: claims involving violations of distribution agreements; claims involving grey market products/parallel imports in countries where Platform is located; claims dealing only with sale price; claims where copyrighted work is used for research, private study, criticism/review, reporting current events, quotations, parody or other equivalent purposes (fair dealing); claims where trademark is used to describe characteristics of goods/services or intended purpose of product/service (honest commercial practices); and IPR infringement notices from countries other than the country where takedown is requested.

To report IP infringement: First attempt direct resolution with the seller/creator who posted the infringing content. Then submit via TikTok Shop IPPC if you have access, or use the TikTok Shop Sở hữu trí tuệ Rights Report form if unable to access IPPC. If you receive a notice in error: Contact the IPR owner directly to request retraction; file Kháng cáo through Seller Center (sellers) or TikTok app (creators); follow specific appeal guidelines for sellers or creators; include complete documentation in appeal covering identity, contact info, counter-notification explanation, proof of rights/authorization, good-faith statement, and any additional supporting evidence.
